OBJECT

The purpose of these General Terms and Conditions is to define the terms and conditions for making available the services of the maroussia-dubois.be website, hereinafter referred to as the “Service”, and the conditions of use of the Service. Any access to the site www.maroussia-dubois.be or any use of it implies the unconditional acceptance and respect of all of these General Conditions. Consequently, these constitute a contract between the Service and the User.

In the event that the User does not wish to accept all or part of these General Conditions, he is asked to renounce all use of the Service.

DEFINITIONS

User: the User is any person who uses the Site or one of the services offered on the Site.

User Content: the term "User Content" refers to the data transmitted by the User in the sections of the Site.

ACCESS TO THE SERVICE

The Service is accessible free of charge to any User with internet access.  All costs relating to access to the Service, whether hardware, software or internet access , are exclusively the responsibility of the User. The User is solely responsible for the proper functioning of his computer equipment as well as his access to the Internet.

Certain sections of the Site are reserved for Members after identification using their Username and Password.

Maroussia Dubois reserves the right to refuse access to the Service, unilaterally and without prior notification, to any User who does not comply with these terms of use.

Maroussia Duboismet implements all reasonable means at its disposal to ensure quality access to the Service, but is under no obligation to achieve this. 

Maroussia Dubois cannot, moreover, be held responsible for any malfunction of the network or servers or any other event beyond reasonable control, which would prevent or degrade access to the Service.

Maroussia Dubois reserves the right to interrupt, temporarily suspend or modify without notice access to all or part of the Service, in order to ensure its maintenance, or for any other reason, without the interruption giving rise to the right to no obligation or compensation. 

PERSONAL DATA

Only personal data that the User voluntarily provides is collected.

This personal data is kept for a limited period in a computer file.

Maroussia Dubois undertakes to take all necessary precautions to ensure the security of the user's personal data, in particular to prevent them from being distorted, damaged or communicated to unauthorized third parties.

MODIFICATION OF THIS AGREEMENT

Maroussia Dubois reserves the right to modify the terms, conditions and notices of this contract at any time.

The User is therefore advised to regularly consult the latest version of the Terms of Use, available on the website www.maroussia-dubois.be

DURATION AND TERMINATION

This contract is concluded for an indefinite period from the moment the User begins to use the Service.

APPLICABLE LAW AND DISPUTES

The relationship between the User and Maroussia Dubois, including the sale, is exclusively governed by Belgian law.

In the event of a dispute between the User and Maroussia Dubois, only the courts and tribunals of Brussels will be competent. The language of the proceedings will be French.

TERMS OF SALES

SCOPE

These General Conditions of Sale (hereinafter the "General Conditions") are intended to define the rights and obligations of the parties in connection with the sale of products (hereinafter the "Products") on the Maroussia Dubois website ( www.maroussia-dubois.be). These General Conditions govern all sales of products made on the Site.

The General Conditions are concluded between, on the one hand, Maroussia Dubois, represented by Productions Associées ASBL, established Rue Coenreats 72, 1060 Brussels Belgium, registered with the Banque-Carrefour des Entreprises de Belgique (BCE) under number 0896.755.397, hereinafter referred to as the "Seller" and, on the other hand, the person wishing to consult the Site and make a purchase there, hereinafter referred to as the "Buyer". The Buyer and the Seller are hereinafter jointly referred to as the “Parties”. The Parties agree that their relations will be governed exclusively by the General Conditions, excluding any conditions previously available on the Site or any general conditions of the Buyer.

Any order for a product offered on the Site (hereinafter the "Order") presupposes the prior consultation and express acceptance of the General Conditions by the Buyer without however this acceptance being conditioned by a handwritten signature of the Buyer. . Confirmation of the order form constitutes an electronic signature which has, between the parties, the same value as a handwritten signature and is proof of the completeness of the order and of the payment of the sums due in execution of the said order.

The General Conditions relate exclusively to non-commercial Buyers (consumers).

The Buyer who wishes to place an order declares to have full legal capacity.

Availability of products and scope of contract

 

The Seller implements all reasonable means to display the availability of products in real time on the Site, but cannot be held liable if a product is no longer available to honor the order made by the Buyer.

In case of unavailability of one of the products ordered, the buyer will be informed and will have the possibility, either to modify his order, or to cancel it, in which case he will be refunded the amount of his order if he has already made the payment.

The photographs, texts and other descriptive elements illustrating the products do not enter into the contractual field. The Seller declines all responsibility if these photographs or texts are incorrect.

PURCHASE PRICE AND DELIVERY COSTS

 

The price of each product is displayed on the Site in euros, including VAT.

Delivery costs are the responsibility of the Buyer.

ORDERS

 

The Seller cannot be held responsible for the consequences of the communication of erroneous information by the Buyer when ordering.

By clicking on "Validate my order", the Buyer definitively confirms his order and undertakes to pay the full amount due.

The Seller will confirm each order by sending an e-mail to the Buyer within 48 hours of placing the order, at the address indicated by the Buyer.

The Seller will only deliver the goods after full payment, if necessary after verification by the issuing bank.

PAYMENT METHODS

Payment for purchases is made with Visa or MasterCard or by conventional European payment methods (Bancontact, ING, Belfius, KBC, CBC, Carte Bleue, etc.) via the secure PayPal system (www.paypal.com).

The Buyer will choose one of the payment methods offered and will follow the instructions that will be displayed on the Site upon confirmation of the Order.

RESERVATION OF OWNERSHIP AND TRANSFER OF RISK CLAUSE

 

The products ordered remain the property of the Seller until full payment of the purchase price.

The transfer of risks to the User occurs when the products ordered are made available to the delivery person.

Proof of this provision can be provided by all legal means, in particular, where applicable, by the package tracking system used by the deliverer.

The Buyer must sign the delivery receipt.
